1. Acceptance of Terms
These Terms of Service govern access to and use of Funder Games LLC Services. By downloading, installing, accessing, or using the Services, the user agrees to these Terms, any product-specific terms, and applicable platform terms.
2. Eligibility
Users must be old enough to use the Services under applicable law and platform rules. If a user is under the age of majority, use of the Services must be with permission and supervision of a parent or legal guardian where required.
3. Accounts and Authentication
Some features may require platform sign-in, OAuth sign-in, or a Funder Games account. Users are responsible for maintaining control of their account credentials and for activity occurring through their account. Funder Games may refuse, suspend, or terminate accounts that violate these Terms.
4. License to Use the Services
Subject to these Terms, Funder Games grants a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal entertainment purposes. No ownership interest is transferred.
5. Purchases, Virtual Items, and Entitlements
The Services may offer in-app purchases, downloadable content, cosmetics, virtual items, subscriptions, or other paid features. Virtual items and entitlements are licensed, not sold. They have no cash value, cannot be redeemed for money, and may be changed, suspended, or removed as permitted by law and platform rules.
- Platform stores process payments and refunds under their own rules.
- A purchase may require an internet connection and platform account to verify entitlement.
- Funder Games may limit, revoke, or correct purchases affected by fraud, chargeback, exploit, error, or violation of these Terms.
6. Subscriptions and Paid Features
If subscriptions are offered, renewal, cancellation, pricing, trial, and refund rules will be disclosed at purchase and governed by applicable platform policies. Users are responsible for managing subscriptions through the platform account used to purchase them.
7. User Conduct
- Use the Services only for lawful personal entertainment.
- Do not harass, threaten, impersonate, defame, or abuse others.
- Do not exploit bugs, cheats, unauthorized scripts, bots, automation, memory editing, or modified clients.
- Do not interfere with networks, servers, security systems, or platform services.
- Do not upload or transmit malicious code, unlawful content, or infringing material.
- Do not attempt to sell, sublicense, rent, or commercially exploit the Services without written permission.
8. Anti-Cheat and Security
Funder Games may use technical, platform, and operational measures to detect cheating, fraud, abuse, unauthorized modifications, account compromise, and security threats. Enforcement may include warnings, feature restrictions, leaderboard removal, account suspension, entitlement revocation, or termination.
9. User Content and Feedback
If the Services allow users to submit content, comments, names, support materials, or feedback, the user grants Funder Games a worldwide, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, display, and distribute that content as necessary to operate, improve, support, and promote the Services. Users retain ownership of their content subject to this license.
10. Ownership and Intellectual Property
Funder Games and its licensors own all rights in the Services, including software, artwork, designs, UI, characters, worlds, names, logos, trademarks, audio, music, text, data, gameplay systems, and documentation. All rights not expressly granted are reserved.
11. Third-Party Platforms and Services
The Services may depend on Apple, Google, Steam, Firebase, platform achievements, leaderboards, cloud saves, payment systems, and other third-party services. Funder Games is not responsible for third-party service outages, policies, or actions outside its control.
12. Updates and Changes to Services
Funder Games may update, patch, rebalance, add, remove, suspend, or discontinue features, content, virtual items, or services. Updates may be required to continue using online features.
13. Suspension and Termination
Funder Games may suspend or terminate access for violations of these Terms, legal requirements, security risk, fraud, platform enforcement, or discontinuation of Services. Upon termination, the license ends and users must stop using the Services.
14. Disclaimers
The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. Funder Games disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and error-free operation.
15. Limitation of Liability
To the maximum extent permitted by law, Funder Games will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, service interruption, or unauthorized access. Any liability will be limited to the greater of the amount paid by the user for the affected Service in the prior twelve months or the minimum amount permitted by law.
16. Indemnification
Users agree to defend and hold harmless Funder Games and its owners, employees, contractors, and partners from claims arising from misuse of the Services, violation of these Terms, violation of law, or infringement of rights.
17. Dispute Resolution and Governing Law
These Terms are governed by the laws applicable to Funder Games LLC, without regard to conflict-of-law rules, unless consumer protection law requires otherwise. The parties will first attempt to resolve disputes informally by contacting support. Any mandatory arbitration, venue, class waiver, or small-claims terms should be reviewed by counsel before publication.
18. Changes to Terms
Funder Games may update these Terms. Continued use after an updated effective date constitutes acceptance, except where additional consent is required by law.
